These Terms of Use ("Terms") govern your access to and use of throughthewoods.marketing (the "Site"), operated by Pathmark Studios LLC, a Wyoming limited liability company that also does business as Through the Woods Marketing ("we," "us," "our").
By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Please read Section 11 carefully. It requires most disputes to be resolved through individual arbitration rather than in court, and it waives your right to participate in a class action.
The Site is an informational and marketing website. It describes who we are, what services we offer, and how to get in touch.
Using the Site does not create a client relationship. Nothing on the Site is an offer to provide services, and submitting our contact form does not obligate either of us to anything. We become your service provider only when we have both signed a written agreement describing the work, the price, and the terms.
If you do become a client, that signed agreement governs our work together. Where it conflicts with these Terms, the signed agreement controls.
We publish articles, guides, frameworks, and opinions about marketing, branding, search, and advertising. This content is general information, not advice tailored to your situation.
Marketing results depend on factors we do not control — your market, your product, your pricing, your operations, your competitors, and platform algorithms that change without notice. Nothing on the Site is a promise or guarantee of any particular business result, including traffic, rankings, leads, or revenue. Any examples, case studies, or figures we publish describe what happened for a specific client under specific conditions and are not a prediction of what will happen for you.
Nothing on the Site is legal, tax, accounting, or financial advice. Consult a qualified professional before acting on anything you read here.
The Site and everything on it — text, graphics, logos, photographs, illustrations, layout, design, frameworks, methodologies, and software — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
"Pathmark Studios," "Through the Woods Marketing," the Pathmark Method, our logos, and our other brand elements are our trademarks. You may not use them without our written permission. What you may do: view the Site, and print or download individual pages for your own reference. You may quote short excerpts of our written content with clear attribution and a link back to the source page.
What you may not do: copy, republish, redistribute, sell, license, or create derivative works from our content; remove copyright or attribution notices; or use our content to train a machine learning model — without our prior written permission.
You agree not to:
- Use the Site for any unlawful purpose, or to violate anyone's rights
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems
- Introduce malware, viruses, or any other harmful code
- Interfere with or disrupt the Site's operation, or place unreasonable load on our infrastructure
- Scrape, crawl, harvest, or use automated tools to extract content or data from the Site, except for search engine crawlers operating in good faith
- Submit false information, impersonate anyone, or misrepresent your affiliation with any person or organization
- Use our contact form to send spam, solicitations, or bulk messages
- Reverse engineer or attempt to derive the source code of any part of the Site
We may suspend or block access to anyone who violates these Terms, without notice.
When you submit information through our contact form or send us email, you keep ownership of what you send. You give us permission to use it for the purpose you sent it — responding to you, preparing a proposal, and running our business. We handle it as described in our Privacy Policy.
Do not send us confidential information before we have a signed agreement. Information you send through the Site is not treated as confidential and does not create a confidentiality obligation on our part. If you need to share something sensitive, ask us for a non-disclosure agreement first.
Feedback. If you send us suggestions, ideas, or feedback about our business or our content, we may use it freely, without obligation or compensation to you. We are not asking for it, and you do not have to send it — but if you do, we want to be clear about what happens to it.
The Site links to websites, tools, and resources we do not own or control. We provide those links because we think they are useful, not because we endorse everything on them. We are not responsible for their content, their practices, or anything that happens to you there. Your dealings with third parties are between you and them.
We work to keep the Site accurate, current, and available. We do not promise that it will be.
To the fullest extent permitted by law, the Site and all of its content are provided "as is" and "as available," without warranties of any kind, express or implied. We specifically disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free; that defects will be corrected; or that the Site is free of viruses or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site — including lost profits, lost revenue, lost data, lost business opportunity, or business interruption — even if we have been advised that such damages are possible.
Our total liability to you for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100.00).
This limit does not apply to liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or gross negligence. It also does not apply to our obligations under a separate signed services agreement, which has its own liability terms.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
You agree to indemnify and hold harmless Pathmark Studios LLC and its members, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
Please read this section carefully. It affects how disputes between us get resolved.
11.1 Talk to us first. If you have a problem, please reach out via our Contact Form describing your issue. Most disputes can be resolved this way. Neither of us may start a formal proceeding until 30 days after sending written notice of the dispute and making a good-faith attempt to resolve it.
11.2 Binding arbitration. If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
11.3 Small claims exception. Either of us may bring an individual claim in small claims court instead, if the claim qualifies and stays in that court.
11.4 Class action waiver. Disputes will be arbitrated on an individual basis only. You and we each waive the right to participate in a class action, collective action, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is found unenforceable, the entire arbitration provision in Section 11.2 is void.
11.5 Injunctive relief. Nothing in this section prevents either of us from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
11.6 Governing law and venue. These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California.
11.7 Your statutory rights. Nothing in these Terms waives any right you have under a consumer protection or privacy law that cannot be waived by agreement.
We may update these Terms. When we do, we will change the "Last updated" date at the top. Material changes take effect 30 days after we post them. Your continued use of the Site after that means you accept the updated Terms. If you do not agree, stop using the Site.
Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest remains in full force.
No waiver. If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms. We may assign them in connection with a merger, acquisition, or sale of our business.
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Site, and they replace any prior understandings about it. They do not replace a signed services agreement, which governs client work.
Termination. We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 4, 6, 8, 9, 10, 11, and 13 survive termination.
